Orrick of the Northern District of California issued an order on 12 August 2024 (Case 3:23-cv-00201, Document 223) allowing the visual artists' core copyright claims against Stability AI, Midjourney, DeviantArt and Runway to proceed. The court accepted that unlicensed training on artists' images constitutes a legally cognisable copyright infringement theory, and identified the LAION five-billion image dataset as the training source at issue.
