Digital Omnibus on AI, Regulation (EU) 2026/1744: AI Act simplification in force, education high-risk compliance deferred to 2 December 2027

Summary

The Digital Omnibus on AI, Regulation (EU) 2026/1744 of 8 July 2026 amending the AI Act, was published in the Official Journal on 24 July 2026 and entered into force on 27 July 2026, turning the 7 May political agreement into law. In the Commission's words, rules for "High-risk AI systems in Annex III" apply "starting 2 December 2027" and rules for "High-risk AI embedded in physical products (machinery, toys, lifts, etc.) in Annex I" apply "starting 2 August 2028"; the previous AI literacy requirement for companies "is simplified, with the Commission and the Member States taking a stronger role in promoting AI literacy"; and the regulation "Prohibits AI systems that generate non-consensual sexually explicit and intimate content or child sexual abuse material", applicable from 2 December 2026. Article 50 transparency duties were not deferred: they have applied since 2 August 2026, with a transitional date of 2 December 2026 only for providers of synthetic-content systems already on the market to meet the machine-readable marking duty in Article 50(2). For European animation programs the operative planning date for high-risk education systems is 2 December 2027, now fixed in law.

Implications for animation education

Animation and digital arts programs in EU institutions that deploy or procure AI systems categorised as high-risk under the AI Act (for example, AI used for student assessment, admission or educational outcome prediction) now have 2 December 2027 as the compliance date, fixed in law rather than conditional on adoption. Programs that have not yet audited their AI systems against the Annex III criteria should use the remaining time for that review. Three things did not move and matter more immediately. Article 50 transparency duties have applied since 2 August 2026, so AI-generated or manipulated image, video and audio published by an institution or its graduates in the EU already carries the marking and labelling duties the Code of Practice describes. The AI literacy duty in Article 4 is now a duty to "take measures to support the development of AI literacy" of staff and of others operating AI systems on the organisation's behalf, with the Commission and Member States promoting literacy; institutions still need a literacy programme, but the obligation no longer implies a guaranteed level. And from 2 December 2026 the new prohibition on systems generating non-consensual sexual deepfakes is directly relevant to any unit teaching synthetic media ethics; the recitals exclude "cartoonish or physically impossible depictions" and "non-realistic artistic nude works that do not realistically depict identifiable natural persons", a line worth teaching as written.
